CONFIDENTIAL INFORMATION.  The MTP Utilities Software ("DEI software"), all associated documentation, and any information concerning the same (including but not limited to this manual), whether received from DEI or any of its personnel, associates, contractors or partners, or through inspection of DEI software is considered "Confidential Information."  All Confidential Information remains the sole property of DEI.  You may not decompile, reverse engineer, disassemble or otherwise reduce DEI software to a human-perceivable form, and you may not modify or create derivative works based DEI software without DEI's explicit written license to do so.  You may not rent, lease, or loan any Confidential Information in whole or in part with written license to do so from Data Expedition, Inc.  You must take reasonable precautions to prevent any unauthorized use, disclosure, publication, or dissemination of Confidential Information.

PATENT, COPYRIGHT AND TRADEMARK.  DEI owns all rights, title, interests, copyrights, and trade secret rights in and to DEI software, and any copies thereof.  DEI software and documentation is protected by patent and copyright laws and international treaty provisions.  You must treat all Confidential Information like any other patented or copyrighted material.  "ExpeDat", "SyncDat", "HyperGate", and "MTP" are trademarks of Data Expedition, Inc.  "Data Expedition, Inc.", "Multipurpose Transaction Protocol", "DEI", and the pith helmet logo are trademarks of Data Expedition, Inc. and are registered with the USPTO.

NO WARRANTY.  DEI HEREBY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  DEI will not be liable for any indirect, special, incidental, or consequential damages of any character including, but not limited to, damages for loss of goodwill, work stoppage, computer failure or malfunction, or for any and all other damages, whether arising in tort (including negligence), contract or otherwise, that stem from any use of the Software and/or other Confidential Information or DEI's performance or failure to perform any obligation under its contract.  The foregoing provisions shall be enforceable to the maximum extent permitted by applicable law.

HIGH RISK ACTIVITIES.  The Software is not fault-tolerant and is not designed or intended for use in hazardous environments requiring fail-safe performance, including without limitation, in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, weapons systems, direct life-support machines, or any other application in which the failure of the Software could lead directly to death, personal injury, or severe physical or property damage (collectively, "High Risk Activities").  DEI expressly disclaims any express or implied warranty of fitness for High Risk Activities.
